TENDING: ACCOMPANIMENT AT THE GATES OF GRIEF

TERMS AND CONDITIONS AGREEMENT

Effective Date: 3/9/25

This Terms and Conditions Agreement (“Agreement”) is entered into by and between Mildred Mary, LLC, Hilary Kinavey, and Carmen Cool (collectively, “Facilitators,” “we,” “us,” or “our”) and the participant (“Participant,” “you,” or “your”) in the Tending: Accompaniment at the Gates of Grief program (“Program”). By purchasing and participating in this Program, you agree to be bound by the terms outlined below.

1. PROGRAM DESCRIPTION

The Tending: Accompaniment at the Gates of Grief program is a virtual gathering designed to support participants in processing grief and sorrow in a communal setting. The Program includes group sessions with guided discussions, reflective exercises, and shared experiences.

This Program is not therapy, counseling, or a substitute for professional mental health care. If you are experiencing a mental health crisis, we encourage you to seek support from a licensed therapist or healthcare provider.

2. NO REFUNDS POLICY

By purchasing the Tending program, you acknowledge and agree that all sales are final. We do not offer refunds, transfers, or credits for any reason, including but not limited to scheduling conflicts, personal circumstances, or dissatisfaction with the Program.

Please consider your availability and commitment before enrolling.

3. PARTICIPANT RESPONSIBILITIES

By enrolling in the Program, you agree to:

• Engage with the material and group process with respect and care for yourself and others.
• Maintain the confidentiality of other participants and their shared experiences.
• Acknowledge that your participation is voluntary and that you are responsible for your emotional and mental well-being.
• Refrain from engaging in harmful or disruptive behavior that could negatively impact the group experience.

The Facilitators reserve the right to remove any participant from the Program at their discretion if conduct is deemed inappropriate or harmful, without refund.

4. DISCLAIMER: NO THERAPY OR MEDICAL ADVICE

The Tending: Accompaniment at the Gates of Grief program is a learning and support space that provides guidance and community reflection on grief and sorrow.

This Program does not:

• Provide therapy, medical advice, or clinical mental health services.
• Establish a therapist-client or fiduciary relationship between you and the Facilitators.
• Serve as a substitute for professional medical, psychological, or therapeutic treatment.

If you require mental health support, we strongly encourage you to seek professional care from a licensed provider.

5. INTELLECTUAL PROPERTY & USE RESTRICTIONS

All Program content, including but not limited to written materials, recordings, exercises, and discussions, is the intellectual property of Mildred Mary, LLC, Hilary Kinavey, and Carmen Cool. You agree that:

• You will not record, reproduce, or distribute any Program materials without express written permission.
• You will not use Program content for commercial purposes or share it outside the Program.

Any violation of this clause may result in legal action.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mildred Mary, LLC, Hilary Kinavey, and Carmen Cool shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or in connection with your participation in the Program. You agree to hold the Facilitators harmless for any decisions or actions you take as a result of your participation.

7. MODIFICATIONS TO THE PROGRAM

We reserve the right to modify, reschedule, or discontinue the Program at our discretion. If unforeseen circumstances require changes, we will make reasonable efforts to inform participants in advance.

8. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the state of Oregon, without regard to its conflict of law principles. Any disputes arising from this Agreement shall first be resolved through good faith negotiations. If resolution cannot be reached, disputes shall be settled through mediation or binding arbitration in Oregon.

9. ACCEPTANCE OF TERMS

By purchasing and participating in the Tending: Accompaniment at the Gates of Grief program, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
